Hi All,
News at last! It's only taken 18 months, but I had a call from an investigator at the Information Commissioner last week to say that the prohibition on disclosure that blocked the release of fire inspection reports was removed in the new Fire Safety law that came into force 1 October 2006. London Fire and Emergency Authority are now re-processing my request and they seem willing to release the data. Their main concern is whether the law provides retrospective acccess to data held before 1 October. Obviously I argue that it does, but they are currenty consulting their lawyers. Any lawyers out there who would care to comment on this are welcome to do so.
Regards,
Heather Brooke

Heather -

Any developments from the Information Commissioner? I recently put in a request to the Avon Fire and Rescue and experienced the same refusal to disclose this information. I can't believe sixteen months can have passed with NO decision? I am so frustrated!

Hello all,
The efficiency and professionalism of the Information Commissioner's Office strikes again. NO, amazingly, I still have NOT had even so much as a status report on this investigation. I know the BBC has put in similar requests to some other brigades. We are all waiting for a decision from the ICO, which I'm sure even the brigades would welcome just so they know where they stand and don't have to keep seeking legal advice.

Hello Heather,

Have you tried this with any other Fire Brigades? If so, have you
had any response?

Hi Ken,
No he has not! I've emailed and telephoned several times to get the status of all my requests. Finally, two weeks ago a representative of the Commissioner's Office called me. This case has yet to even be assigned to an investigator!

If the Commissioner would actually hurry up and make a forthright decision then it would save everyone time and money. His delay and waffling just gives more work to lawyers as every public authority seeks legal advice on an issue which only the Commissioner and Tribunal can decide.

Heather, has the Commissioner not yet replied to your letter of 6th June about Fire Safety Reports?
(Which I am pressing our Fire Authority to publish.)
